Miss Martha Henn to Mr James R Stuchfield

CONVEYANCE of a Messuage or Tenement Malthouse buildings and pieces of Land situate at Sulgrave in the county of Northampton

 

THIS INDENTURE made the twenty first day of October One thousand eight hundred and sixty nine BETWEEN Martha Henn of Sulgrave in the County of Northampton Spinster of the one part and  James Roberts Stuchfield of Helmdon in the said County of Northampton Gentleman of the other part WHEREAS Joseph Henn late of Sulgrave aforesaid farmer deceased was at the time of his death seized in fee simple in possession of the hereditaments and premises herein after described and granted and by his last Will and Testament bearing date the sixteenth day of November One thousand eight hundred and sixty four after certain pecuniary bequests therein mentioned gave and bequeathed All that Freehold House and premises with malt kiln yard gardens orchard and all those Four closes of pasture Land adjoining and thenin the occupation ofHenry Webb Cooke unto his daughter the said Martha Henn AND whereas the said Joseph Henn departed this life on the thirty first day of January One thousand eight hundred and sixty eight without having altered or revoked his said Will which on the sixth day of April One thousand eight hundred and sixty eight was dulyproved by Joseph Henn the younger one of the Executors therein named(the other Executor having disclaimed) in the Northampton District Registry of Her Majesty’s Court of ProbateAND whereas the said Martha Henn hath contracted with the said James Roberts Stuchfield for the sale to him of the same hereditaments for the sum of One thousand and three hundred pounds NOW this Indenture Witnesseth that in pursuance of the said Agreement and in consideration of the sum of One thousand three hundred pounds at or before the execution hereof by the said James Roberts Stuchfield to the said Martha Henn in hand well and truly paid, the receipt whereof the said Martha Henn hereby acknowledges and therefrom releases and discharges the said James Roberts Stuchfield his heirs executors administrators and assigns She the said Martha Henn Doth by these presents grant conveyand confirm unto the said James Roberts Stuchfield and to his heirs ALL THAT Messuage or Tenement  late in the occupation of  Job Burman situate and being in the Village of Sulgrave in the County of Northampton with the Malthouse outbuildings garden homeclose and appurtenances thereto adjoining and belonging And also all those three several closes or inclosed Grounds of Meadow or Pasture land now or late in the occupation of the said Job Burman situate in Sulgrave aforesaid at the back of the before mentioned premises which said three several closes comprised the allotment of fifteen Acres one rood and ten perches which upon the inclosure of the open and common fields of  Sulgrave aforesaid  was made to Robert Gardner in lieu of one yard land with commons thereto belonging and all which said premises contained together  including the site of the buildings seventeen Acres and twenty seven perches or thereabouts Together with all houses outhouses edifices buildings ways waters watercourses privileges advantages emoluments and appurtenances to the said Messuage or Tenement buildings pieces or parcels of land hereditaments and premises respectively belonging And the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof and of any part thereof And all the estate right title use trust property claim and demand whatsoever at Law and in Equity of the said Martha Henn in to or out of the same hereditaments and all and singular other the premises hereinbefore described and hereby granted and conveyed or intended so as to be with their rights members and appurtenances unto the said James Roberts Stuchfield and his heirs To the use of the said James Roberts Stuchfield his heirsand assigns for ever AND the said Martha Henn doth hereby for herself her heirs executors and administrators covenant with the said James Roberts Stuchfield his heirs and assigns that notwithstanding any act done or permitted by the said Martha Henn to the contrary she the said Martha Henn now hath in herself good right to convey the said Messuage or Tenement and buildings pieces or parcels of land hereditaments and premises hereby conveyed to the uses and in manner aforesaid And also that notwithstanding any such act as aforesaid the same hereditaments and premises shall and may from time to time and at all times hereafter be held occupied and enjoyed accordingly without let suit eviction denial or disturbance of or by the said Martha Henn or any person or persons rightfully claimimg under or in trust for her And that free from all incumbrances created or suffered by the said Martha Henn or any person rightfully claiming  under or in trust for her And moreover that she the said Martha Henn and all persons rightfully claiming any estate or interest in the said premises under or in trust for her will from time to time and at all times hereafter at the request and costs of the said James Roberts Stuchfield his heirs and assigns execute all such further assurances for the further better or more perfectly or satisfactorily assuring and confirming the said hereditament and premises hereby granted and released or otherwise as he or they shall direct or appoint as by the said James Roberts Stuchfield his heirs and assigns or his or their Counsel in the law shall require and as shall be rendered to be done and executed IN WITNESS whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written
